Terms of Service

1. The seller

FORZA is operated by INCEPTO Dev ("we", "us", "the seller"). By creating an account or continuing to use the service, you agree to these terms and enter into a contract with INCEPTO Dev. If you use FORZA on behalf of an organization, you confirm you have authority to bind that organization; otherwise you confirm you are of legal age in your jurisdiction.

2. The service

FORZA is a subscription gym management system: member directories, membership plans, payment recording, check-ins, reporting and a member self-service portal. Each gym gets an isolated workspace. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. We do not guarantee uninterrupted or error-free operation of the service.

3. Free trial and subscription

New gym workspaces include a 30-day free trial. After the trial ends, continued access requires a paid subscription of €29.99 per month, billed monthly until cancelled. You can cancel at any time; access continues until the end of the current billing period.

Payments are processed securely by Stripe. By subscribing you agree to Stripe's terms.

INCEPTO Dev is the seller of all FORZA subscriptions. For billing questions, cancellations or refunds, contact us at info@gymforza.com.

4. Acceptable use

You must not misuse the service, including:

• using it for unlawful purposes, fraud or spam;
• infringing intellectual property rights;
• introducing malware, probing or scanning the service, or scraping it;
• reverse engineering, reselling or redistributing the service, or circumventing technical limits.

5. Your account and content

You must keep your account credentials confidential and are responsible for all activity under your account. You must provide accurate information and keep it up to date. You retain ownership of the data you enter (members, payments, and similar records); you grant us a limited license to host and process that content solely to provide the service.

6. Intellectual property

We retain all ownership of the service and its intellectual property, including the software, documentation and FORZA branding.

7. Warranties and liability

The service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law. We are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill). Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.

8. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. When your access ends, you may request an export of your workspace data within 30 days; after that it may be deleted.

9. General

These terms are governed by the laws of the Republic of Croatia, and disputes will be resolved in the courts of Croatia. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control.
